Usage Framework.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ARJUN — AI for Resilient Jobs, Urban Air Quality & Next-Gen Skills Council ("ARJUN," "we," "us," or "our"), an initiative of the Government of Haryana, administered by Exiver Projects Private Limited. By accessing, browsing, or using the ARJUN website, dashboards, APIs, or any associated digital services (collectively, the "Platform"), you agree to comply with and be bound by these Terms in their entirety.

If you do not agree to these Terms, you must immediately discontinue access to and use of the Platform.

2. Eligibility

The Platform is intended for use by individuals who are at least 18 years of age, or who access it under the supervision of a parent or legal guardian. By using the Platform, you represent and warrant that you possess the legal capacity to enter into this agreement under applicable Indian law.

3. Scope of Services

The Platform provides the following services on an informational and public-interest basis:

• Real-time and historical air quality monitoring dashboards and data visualizations for the State of Haryana;
• Information regarding the HCASDP (Haryana Climate & AI Sustainable Development Program) and associated government initiatives;
• Employment and skill development program information, including placement statistics and training resources;
• Research publications, policy documents, and data insights;
• Contact and inquiry submission mechanisms for institutional and public engagement.

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice or liability.

4. Intellectual Property

All content, materials, designs, text, graphics, logos, icons, images, software, source code, data compilations, and other intellectual property displayed on or accessible through the Platform (collectively, "Content") are the property of ARJUN Council, the Government of Haryana, and/or Exiver Projects Private Limited, and are protected under the Copyright Act, 1957; the Trade Marks Act, 1999; and other applicable intellectual property laws of India.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial, informational purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Content without prior written authorization.

5. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable local, state, national, or international law;
• Attempt to gain unauthorized access to any systems, networks, or data connected to the Platform;
• Introduce viruses, malware, or any other harmful code to the Platform;
• Scrape, crawl, or harvest data from the Platform through automated means without express written consent;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Interfere with or disrupt the integrity or performance of the Platform or its underlying infrastructure;
• Use air quality or environmental data provided by the Platform to make health or safety decisions without independent verification from official government sources.

6. Data Accuracy & Disclaimer

The environmental, meteorological, and air quality data displayed on the Platform is sourced from third-party API providers, public IoT sensor networks, and government monitoring stations. While we endeavour to ensure accuracy, we make no representations or warranties regarding the completeness, accuracy, reliability, timeliness, or suitability of such data for any particular purpose.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ARJUN, the Government of Haryana, Exiver Projects Private Limited, and their respective officers, employees, agents, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from or related to:

• Your access to, use of, or inability to access or use the Platform;
• Any reliance placed on data, content, or information obtained from the Platform;
• Any unauthorized access to or alteration of your transmissions or data;
• Any conduct or content of any third party on or connected to the Platform.

8. Indemnification

You agree to indemnify, defend, and hold harmless ARJUN, the Government of Haryana, Exiver Projects Private Limited, and their respective officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or in connection with your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

9. Third-Party Links & Services

The Platform may contain hyperlinks to third-party websites, services, or resources. Such links are provided for convenience only and do not constitute an endorsement or approval by ARJUN. We have no control over the content, availability, or practices of third-party sites and shall not be responsible or liable for any damage or loss caused or alleged to be caused by their use.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Chandigarh, Haryana, India.

11. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect.

12. Amendments

We reserve the right to modify these Terms at any time at our sole discretion. Material changes will be communicated through a prominent notice on the Platform. Your continued use of the Platform following such modifications constitutes acceptance of the revised Terms.
